1. The bill is an attempt to complete
the process of reorganization of J&K whose assembly elections are long due
since the centre's takeover of control in 2018 and also to accommodate the
recommendations of the Delimitation Commission.
2. The bill seeks to increase the
strength of the legislative assembly of the union territory of J&K to 114
from 107.
3. Provides for the reservation of 9
seats for Scheduled Tribes for the first time.
4. The bill also seeks to provide representation to two “Kashmiri Migrants” and one member from “Displaced Persons from Pakistan occupied Jammu and Kashmir (PoK)” in the Legislative Assembly of the UT of J&K intended to preserve their political rights as well as their social and economic development.
5. Rationale: Due to 1947 Pakistani aggression in Jammu and Kashmir and Indo-Pak wars of 1965 and 1971, families from PoK and ChhambNiabat area, respectively migrated to the erstwhile J&K & settled there, accounting for 41,844 displaced families. A need for their representation in the policy making processes has been emphasised by the bill.
